The Relief a Bankruptcy Case Can Provide

Bankruptcy can stop foreclosures, garnishments and virtually all other types of collection activity by creditors. In other words, the debtor is no longer required by law to pay any debts that are discharged. This also allows a person’s credit score to repair much faster than normal. The discharge operates as a permanent order from the Court, directed to the creditors of the debtor that they must stop any and all collection activity on the discharged debts. This includes legal action, law suits, garnishments and all communications with the debtor, including telephone calls, collection letters and personal contact.

Bankruptcy as an Alternative to Loan Modifications, Deeds in Lieu, Short Sales, Etc.

Bankruptcy is frequently a preferable alternative to short sales, mortgage loan modifications, creditor workouts, settlements, payment plans, debt consolidation and deeds in lieu of foreclosure. These courses of action often include hidden tax implications which simply do not apply in bankruptcy. Also, as many home owners are learning, loan modifications can be time consuming, difficult, and frequently impossible to obtain. It has become increasingly more common for home owners hopelessly buried in debt to use bankruptcy to surrender a home that they no longer have equity in and cannot afford. In this economy, many people who never considered bankruptcy before are filing in record numbers, including medical doctors, dentists, bankers, business owners, attorneys and other professionals. These people are frequently filing bankruptcy for the same reasons you may be considering it. This economy has caused significant financial problems for many people that were normally unaffected by past recessions.

As a court approved debt relief agency, we help people file for bankruptcy relief under the U.S. Bankruptcy Code. This statement is required under the United States Bankruptcy Code pursuant to Section 528(a)(4).
